NEW DELHI: The prime accused in the recent BMW accident that killed a senior finance ministry official told a Delhi court on Wednesday that her vehicle never hit the victim’s motorcycle, calling the FIR allegations an “afterthought.”
The statement was made by the counsel for Gaganpreet Makkad during the hearing of her bail plea before judicial magistrate first class Ankit Garg. The court directed the investigating officer to present CCTV footage and related documents on Thursday, and also sought the prosecution’s reply to Makkad’s request for internet records of the van driver who transported the injured official to hospital.
Defence arguments
Makkad’s counsel said she immediately took Navjot Singh—the official who later died—to Nulife Hospital in GTB Nagar within 24 minutes. He argued that FIR claims of a rear collision were not corroborated by CCTV evidence.
The lawyer added that despite her own injuries, Makkad arranged help for the victim, made her children, domestic staff, and husband sit on the footpath, and handed her phone to a bystander to call the PCR at 1.39 pm. “She identified herself to the injured and did not flee,” he said.
The counsel further argued that Section 105 of the Bharatiya Nyaya Sanhita (culpable homicide not amounting to murder) was wrongly applied as there was no intent to cause death, stressing that Makkad had cooperated with the investigation and thus met the conditions for bail.
Prosecution’s stand
Opposing the bail plea, the public prosecutor said the deceased’s wife, who lodged the complaint, had insisted on being taken to the nearest hospital, but the accused allegedly prioritised her own legal safety. The prosecution maintained that the FIR, though delayed, correctly reflected events leading to Singh’s death.
