Jaipur: The Supreme Court of India has directed the Acting Chief Justice of the Rajasthan High Court, Sanjeev Prakash Sharma, to sympathetically consider the plea of a principal district and sessions judge challenging his frequent transfers and to take an appropriate decision in consultation with the administrative committee of judges, preferably within two weeks.

A bench comprising Chief Justice of India Surya Kant and Justices Joymalya Bagchi and Vipul M Pancholi, while disposing of the petition on December 19, observed that the petitioner Dinesh Kumar Gupta’s earlier postings were based on his “outstanding service record” and could not be treated as punitive in nature.

The court noted that Gupta had earlier served as a member of the State Legal Services Authority and as director (law) in the Jaipur Development Authority.

In his petition, Gupta had expressed concern over his recent posting as district and sessions judge at Jalore, pointing out that he has only about 10 months of service left before superannuation and is suffering from serious health issues requiring treatment in Jaipur. He had sought a posting near Jaipur in a position commensurate with his current rank.

While disposing of the matter, the Supreme Court also took note of the fact that Gupta had already submitted a detailed representation to the Rajasthan High Court on December 3 regarding his grievance.
