THANE: The Motor Accident Claims Tribunal (MACT) in Thane has awarded ₹1.23 lakh compensation with 9% annual interest to a 49-year-old road accident victim, rejecting his original demand of ₹35.3 lakh. The tribunal ruled that the man suffered no functional disability despite injuries from the crash.

The incident took place on May 12, 2019, near Bisleri Junction on the Western Express Highway, when the claimant, riding pillion on a motorcycle, was hit by a speeding Maruti Celerio. He sustained fractures and other injuries, receiving treatment across multiple hospitals. Police later booked the car driver for rash and negligent driving.

The vehicle’s owner and insurer were held jointly liable, but Presiding Member R.V. Mohite dismissed the plea of permanent disability and loss of income. The tribunal noted that while a certificate cited 41% partial disability, it lacked medical backing from the treating hospital. Crucially, the man had resumed work and was earning more at another company after recovery.

The compensation included ₹88,157 for medical bills, ₹25,000 for pain and suffering, and ₹5,000 each for special diet and conveyance, totaling ₹1,23,157. The insurer has been directed to deposit the amount within a month for release into the claimant’s bank account.
